1. Acceptance of terms
By accessing or using this website, or by submitting any form on it, you agree to be bound by these Terms & Conditions ("Terms") and by our Privacy Policy. If you do not agree to these Terms, you must not use the site.
2. About D2SA and the purpose of this site
This site is operated by D2SA (Pty) Ltd (registration number 2013/055313/07; registered address Welgedaan Estate Office, 57 Bruydegom Street, Saldanha) for the purpose of marketing Welgedaan Estate.
The site is informational and promotional only. Nothing on the site constitutes a binding offer to sell, lease, or transfer any property, plot, dwelling, or interest in property. Any sale arises only on the signing of a separate written sale agreement between D2SA and the purchaser.
3. Use of the site
You may use this site for your personal, non-commercial information needs in considering a relationship with D2SA. You may not:
- Scrape, crawl, harvest, or extract content systematically by automated means;
- Submit automated, scripted, or bulk form submissions;
- Reverse-engineer or attempt to derive the source code of the site beyond what's accessible to a normal browser;
- Attempt to gain unauthorised access to any part of the site, the server, or any connected database;
- Interfere with the operation of the site, including by introducing viruses, malware, or denial-of-service traffic;
- Use the site in any way that breaches South African law or any third-party rights.
4. Intellectual property
All content on this site - including text, photographs, architectural renderings, floor plans, brand identity, source code, and design elements - is the property of D2SA or licensed to D2SA. The site is protected by copyright, trade-mark, and other intellectual-property laws of South Africa and international treaties.
D2SA grants you a non-exclusive, non-transferable, revocable, personal-use licence to view the site in a standard web browser. You may not reproduce, redistribute, modify, or commercially exploit any content without D2SA's prior written consent. Brief quotations for the purposes of bona-fide review or commentary are permitted in line with fair dealing under the Copyright Act 98 of 1978.
5. Accuracy of information
D2SA takes reasonable care to ensure information on the site is accurate, but the site is provided "as is". Prices, floor plans, finishes, schedules, school references, and renderings are indicative and may change. In particular:
- Indicative yields, return projections, and Saldanha Bay statistics on the investor (B2B) pages are illustrative ranges based on typical assumptions, not commitments or financial advice.
- Floor plans and elevations are subject to engineering, council approval, and as-built variation.
- The binding documents are the signed sale agreement and (where applicable) the sectional-title or homeowners' association documentation provided to a purchaser.
D2SA does not warrant that any information on the site is current, complete, or error-free, and will not be liable for losses arising from reliance on indicative information.
6. Property listings are an invitation to treat
Listings displayed on the Homes for Sale page, and any specific plot, unit, or home referenced elsewhere on the site, are an invitation to treat under South African contract law - not an offer. A binding agreement of sale arises only on the signing of a written sale agreement by both parties. D2SA reserves the right to withdraw, amend, or substitute any listed property at any time before such signing.
7. External links
The site contains links to third-party websites (including Google Maps, Facebook, Instagram, YouTube, and others) for convenience and reference. D2SA does not endorse the content, products, or services of those sites and is not responsible for their availability, security, or privacy practices. Linking to those sites is at your own risk.
8. User-submitted information
When you submit any form on the site, you warrant that the information you provide is accurate, your own, and not infringing on any third party's rights. The handling of personal information you submit is governed in full by the Privacy Policy.
By submitting, you also confirm that you have ticked the required consent boxes acknowledging the Privacy Policy and these Terms. Where you have additionally ticked the optional marketing-consent box, you agree to receive marketing communications from D2SA about Welgedaan Estate and other D2SA developments, until you withdraw that consent.
9. Limitation of liability
To the maximum extent permitted by South African law (including the Consumer Protection Act 68 of 2008), D2SA's aggregate liability arising from your use of the site is limited to the greater of ZAR 1,000 or the total amount paid by you to D2SA in connection with the site.
D2SA is not liable for any indirect, special, consequential, or punitive damages, loss of profit, loss of business opportunity, or loss of goodwill arising from use of (or inability to use) the site, even if D2SA has been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot lawfully be excluded under South African law.
10. Indemnity
You indemnify D2SA, its directors, employees, agents, and Operator (Kitchfors CC trading as "The Rebellion") against any third-party claim, loss, or damage arising from your misuse of the site or breach of these Terms.
11. Changes to these terms
D2SA may amend these Terms from time to time. Material changes will be notified by a banner on the home page for at least 14 days before the change takes effect. The "Last updated" date at the top of this page reflects the current version. Continued use of the site after a change indicates acceptance of the amended Terms.
12. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. The parties consent to the exclusive jurisdiction of the Western Cape Division of the High Court of South Africa in respect of any dispute arising out of or in connection with these Terms.
13. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force. These Terms (together with the Privacy Policy) constitute the entire agreement between you and D2SA in respect of your use of the site, and supersede any prior understandings.
